GENERAL TERMS AND CONDITIONS FOR THE RENTAL OF SKI EQUIPMENT

Rental provider details

Business name: Biker RS di Stefan Senoner

Registered office: Via Dorives

VAT number: 02992660213

Email: info@bike-rs.it

Telephone: 3339600898

1. Rental period

1-a) Equipment may be collected from 3:00 p.m. on the day before the rental start date at no extra charge, unless otherwise expressly communicated to the customer before the contract is concluded.

1-b) Equipment must be returned no later than 9:00 a.m. on the day after the last rental day, unless otherwise agreed.

1-c) If equipment is returned late, additional charges may apply in accordance with the price list made available to the customer before the contract is concluded. Any charge for an additional rental day must be expressly provided for, proportionate and clearly communicated to the customer.

2. Payment and identification

2-a) The rental fee may be paid online in advance using the payment methods offered during booking, or at the shop when the equipment is collected, according to the arrangements agreed with the customer.

2-b) The prices, discounts and promotions applicable are those communicated to the customer before the contract is concluded. Unless otherwise stated, offers cannot be combined. Where more than one discount applies, the most favourable discount will be granted where provided for by the relevant promotional terms.

2-c) The rental provider may request a valid identity document to identify the customer and manage the rental relationship. A copy of the document will be obtained and retained only where necessary for a legitimate purpose and in compliance with applicable data-protection law.

2-d) The price of the additional contractual guarantee described in Article 4 is not included in the standard rental price and will be charged only if the customer expressly chooses to purchase it.

3. Customer responsibilities

3-a) The customer must take proper care of the rented equipment and use it in accordance with its intended purpose, the instructions provided and applicable safety guidance.

3-b) The customer may not permanently transfer the equipment to third parties or allow its use by unauthorised persons without the rental provider's prior consent.

3-c) The customer must take reasonable steps to prevent theft, loss, accidental exchanges and damage to the equipment.

3-d) The customer is liable for damage, loss or failure to return the equipment to the extent attributable to the customer under the law and these terms. The mere discovery of damage upon return does not automatically establish liability. The rental provider's responsibilities, and any responsibilities that cannot legally be excluded or limited, remain unaffected.

3-e) The customer and the rental provider's staff may check the condition of the equipment at collection and return. Pre-existing damage or damage identified on return may be recorded, including by photographs, in compliance with applicable law.

4. Additional contractual guarantee for accidental breakage and theft

4-a) The standard rental price does not include the additional contractual guarantee described in this article. The guarantee is optional; declining it does not affect any mandatory rights provided by law.

4-b) The customer may purchase the additional contractual guarantee at a cost of 12% of the rental amount. Before purchase, the exact price, scope of cover, exclusions and applicable terms must be made clear to the customer. The guarantee is offered directly by the rental provider and, under the contractual arrangement described here, is not an insurance policy.

4-c) Cover for accidental breakage. If the customer has purchased the guarantee, the rental provider will bear the full repair or replacement costs for accidental breakage or damage falling within the guarantee, with no excess for such events.

Examples of covered damage include:

4-d) Exclusions. The guarantee does not cover damage caused intentionally by the customer, damage resulting from clearly improper use, or damage resulting from gross negligence, where such circumstances are established on the basis of concrete and verifiable evidence.

Damage resulting from failure to follow usage instructions, or from using the equipment in circumstances clearly incompatible with its intended purpose, may also be excluded to the extent permitted by law.

By way of example, damage caused by using skis on asphalt roads or unsuitable surfaces may be excluded. Off-piste use does not, by itself, automatically exclude cover. The specific circumstances, suitability of the equipment, instructions provided and cause of the damage must be considered.

Scratches or superficial marks alone are not sufficient evidence of negligence or improper use.

4-e) Assessment of damage. The customer must notify the rental provider of damage promptly and must stop using the equipment where continued use could compromise safety. The rental provider will assess the nature and circumstances of the damage based on the condition of the equipment, available information and, where necessary, a technical assessment.

Where damage is covered, the costs referred to in clause 4-c will be borne by the rental provider. Where damage is excluded and attributable to the customer, any amount due will be determined in accordance with these terms and applicable law, on the basis of verifiable evidence and without automatic or unjustified charges.

4-f) Theft cover. If the equipment is stolen during the rental period, and the customer has purchased the guarantee and the applicable cover conditions are met, the rental provider will bear 75% of the replacement value of the stolen equipment. The remaining 25% of the replacement value will be payable by the customer.

“Replacement value” means the reasonable and verifiable cost of replacing the stolen equipment with equivalent equipment in terms of category, features, condition and intended use, taking age and depreciation into account where relevant.

The criteria used to determine replacement value must be transparent and communicated to the customer before the contract is concluded. The customer's 25% share is calculated on the basis of that value.

4-g) Reporting theft. The customer must notify the rental provider promptly of the theft, provide information reasonably available and cooperate in establishing the circumstances. Where necessary, the customer must report the theft to the competent authorities and provide relevant documentation to the extent permitted by law.

Cover and any customer contribution will be assessed in accordance with the contract and the specific circumstances. No automatic charge will be made unless the contractual requirements are met.

4-h) No guarantee purchased. If the customer has not purchased the guarantee, any compensation for theft, unrecovered loss or total damage attributable to the customer will be determined on the basis of substantiated loss, the valuation criteria communicated in advance and applicable law.

The following amounts are contractual reference values and may be used only insofar as they are transparent, proportionate and validly incorporated into the contract:

The customer must be able to consult the table and understand the criteria for applying it before the contract is concluded. These amounts do not result in an automatic and irrevocable charge. Any amount payable must be determined in accordance with the contract and the law.

4-i) Partial damage not covered. For partial damage that is not covered by the guarantee and is attributable to the customer, documented repair costs may be charged in accordance with the price list communicated in advance or, where necessary, on the basis of a technical assessment. Unnecessary work or unjustified amounts will not be charged.

5. Equipment replacement

5-a) During the rental period, one free replacement with equipment in the same category and of equivalent value is permitted, subject to availability and the equipment's safety condition.

5-b) Further replacements may incur additional charges, provided these are communicated to and accepted by the customer before the replacement.

5-c) If the customer requests replacement with equipment in a higher category, the price difference may be charged if communicated in advance and accepted by the customer.

5-d) If the customer requests replacement with equipment in a lower category, no price difference will be refunded unless otherwise agreed or required by law.

5-e) If replacement is required because of a defect or safety issue not attributable to the customer, the rental provider will consider an appropriate solution without unjustified costs to the customer, subject to applicable agreements and legal obligations.

6. Late return

6-a) If the equipment is not returned by the agreed deadline, the rental provider will contact the customer to request its return and clarify the circumstances of the delay.

6-b) Additional charges may be applied in accordance with the price list made available to the customer before the contract was concluded, provided they are clear, proportionate and compliant with applicable law.

6-c) Where concrete evidence suggests theft or unlawful appropriation, the rental provider may contact the competent authorities. Late return alone does not automatically constitute proof of theft.

7. Early termination and refunds

7-a) The customer may end the rental early by returning the equipment and notifying the rental provider. Unless otherwise provided in the following clauses, specific agreements or mandatory legal rights, unused rental days are not automatically refundable.

7-b) If illness or injury prevents the customer from continuing to use the equipment, the customer may request a refund for the remaining unused days and provide the evidence strictly necessary to substantiate the impediment.

7-c) If the request is approved, the refund will be calculated from the day following the actual return of the equipment and will cover only the remaining unused days, unless otherwise agreed or required by law.

7-d) This article must be read together with Article 9 and does not restrict any mandatory consumer rights.

8. Illness or injury

8-a) In the event of illness or injury, the customer must promptly inform the rental provider and return the equipment as soon as reasonably possible, taking their health and safety into account.

8-b) To request a possible refund for unused days, the customer must provide suitable evidence of the impediment, limited to the information necessary to assess the request.

8-c) Any refund due will be calculated in accordance with Article 7 and the actual date on which the equipment is returned.

8-d) Health information will be handled confidentially, for specified purposes and on a valid legal basis, in accordance with Regulation (EU) 2016/679 (GDPR) and applicable law. Only necessary data will be requested and retained.

9. Online bookings, cancellations and payments

9-a) Equipment may be booked online at the prices and under the payment terms displayed during the booking process. Before placing the order, the customer must be able to review the pre-contractual information and these terms and conditions.

9-b) If the cancellation request is received at least 48 hours before the scheduled collection time, the rental provider will issue a full refund of the amounts paid for the rental, subject to any separate services already performed and lawfully payable, where applicable and disclosed in advance.

9-c) For cancellation requests received after that deadline, the cancellation terms communicated to the customer before the contract was concluded will apply, without prejudice to mandatory legal rights, more favourable terms offered by the rental provider, and Articles 7 and 8 concerning illness or injury.

9-d) Refund requests due to illness or injury must be communicated promptly and supported in accordance with Articles 7 and 8. The rental provider will assess the request under these terms and applicable law.

9-e) Before completing an online booking, the customer must be able to access, save and retain the contractual terms. Acceptance of the terms and any purchase of the additional guarantee must be capable of being evidenced. The ordering process must clearly state the total price, additional costs, payment methods and the obligation to pay.

9-f) The rental provider will send booking confirmation and contractual information on a durable medium, in accordance with applicable requirements.

9-g) The cancellation terms do not exclude or limit any statutory right of withdrawal. If the rental provider considers a statutory exception to the right of withdrawal applicable, that exception and the related pre-contractual information must be legally reviewed and communicated to the customer where required.

10. Personal data processing

10-a) Personal data are processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Italian law.

10-b) Before or at the time of data collection, as required by law, the customer will receive a privacy notice identifying the data controller and explaining the purposes, legal bases, recipients, retention periods, data-subject rights and how to exercise them.

10-c) Data necessary to manage bookings, payments and the rental relationship are processed on an appropriate legal basis. Marketing communications are handled separately and, where required, sent only on the basis of free, specific and documented consent. Refusing marketing communications does not affect the customer's ability to rent equipment.

10-d) Health data provided in connection with a refund request will be processed only to the extent necessary and on an applicable legal basis. Access will be restricted to authorised persons and the data will be retained only as long as necessary, subject to legal obligations.

11. Governing law and consumer protection

11-a) The contract is governed by Italian law, without prejudice to any mandatory rights and provisions applicable to consumers under European or national law.

11-b) No provision of these terms may be interpreted as an advance waiver of the customer's mandatory legal rights or as excluding the rental provider's liability where such exclusion is not permitted by law.

11-c) Any dispute will be handled in accordance with applicable law, without prejudice to mandatory rules on jurisdiction and consumer protection.

12. Ski binding adjustment

12-a) Ski bindings must be adjusted by competent rental-provider staff, on the basis of the necessary information supplied by the customer and in accordance with applicable technical and safety procedures.

12-b) The customer must not adjust the bindings independently. If an adjustment is required, the customer must contact the rental provider's staff.

12-c) The customer must provide complete and accurate information for binding adjustment. This clause does not exclude the rental provider's responsibility for adjustment errors attributable to it or its legal duties of care and safety.

13. Formation and validity of the rental contract

13-a) The rental contract is concluded according to the online booking procedure or at the shop. The contractual terms must be made available to the customer before the contract is concluded.

13-b) For online bookings, the customer confirms the order through the designated process and receives confirmation on a durable medium. At the shop, the terms are made available before the contract is concluded, and the contract is formed according to the procedure used there.

13-c) The customer is responsible for the accuracy of the information supplied, including information needed for binding adjustment, without prejudice to the rental provider's legal duties to verify information and its responsibilities under the law.

13-d) The invalidity or unenforceability of an individual clause does not automatically invalidate the entire contract, to the extent permitted by law. The clause in question will be dealt with in accordance with applicable law.

13-e) To the extent permitted by law, the rental provider will retain evidence of the version of the terms applicable to the booking and of the customer's acceptance. Any purchase of the additional guarantee must be recorded separately and verifiably.

End of the General Terms and Conditions for the Rental of Ski Equipment.

5a - Conversion Tracking and Custom Audiences with the Meta Pixel

The Meta Pixel is JavaScript code that enables conversions to be tracked and optimised and target groups for remarketing (Custom Audiences) to be identified. Conversion tracking follows users’ actions on the website through a dedicated tracking code configured with target indicators. Custom Audiences is a target-group option that makes it possible to reach on Meta users who have visited the website. These users can be grouped automatically based on specific actions on the website. This information is transmitted to Meta through the tracking code. The Meta account ID is also identified in this way. We inform you that individual users’ personal data remains anonymous to us and is encrypted locally by the system. The data is therefore transmitted securely to Meta, where it is stored and processed. However, Meta may link this data to your Meta account and use it for certain commercial purposes, in accordance with its data-processing guidelines. Further information about Meta’s data processing is available at: https://www.facebook.com/about/privacy/. The encrypted data is used only for the matching process; it is not shared with third parties or other advertisers and is deleted immediately after the matching process ends. You can refuse consent to the use of the Meta Pixel at: http://www.youronlinechoices.com/it/

6 - Google Ads Tracking, Remarketing and Facebook Pixel

Our website uses Google Analytics Remarketing features in connection with the device-based functions of Google AdWords and Google DoubleClick. The service provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. This feature makes it possible to link advertising groups created with Google Analytics Remarketing to the device-based functions of Google AdWords and Google DoubleClick. This may result in targeted and personalised offers being displayed based on users’ interests, previously visited websites, location or how they use their device. Users can disable this feature at any time in their Google account settings at: https://www.google.com/settings/ads/onweb/. As part of Google AdWords and Facebook Advertising, our website uses conversion tracking. When a user clicks on a Google or Facebook advertisement, a conversion-tracking cookie is created. This cookie expires after 30 days and does not allow the user to be explicitly identified. During its validity period, the cookie enables our website to determine whether the user arrived via a click on an advertisement.

6a - Google Ads Remarketing

We use Google Remarketing to reconnect with users on the Google Display Network. Google uses cookies stored on your computer to analyse your use of the website. The information generated by the cookie about your use of the website (including your IP address) is transmitted to and stored on a Google server in the United States. Google then removes the last three digits of the IP address, making it impossible to uniquely assign the IP address. Google complies with the privacy policy of the “US Safe Harbor” agreement and is registered with the US Department of Commerce’s Safe Harbor programme. Google uses this information to evaluate website use, compile reports on website activity for website operators and provide other services relating to website and Internet use. Google may also transfer this information to third parties where required by law or where those third parties process the information on Google’s behalf. Third-party providers, including Google, display advertisements on websites. Third-party providers, including Google, use stored cookies to display advertisements based on a user’s previous visits to this website. Google will not associate your IP address with any other data held by Google. Data collection and storage can be withdrawn at any time with effect for the future. You can disable Google’s use of cookies by visiting the page for opting out of Google ads. Please note, however, that you may then be unable to use all the features of this website. By using this website, you consent to Google processing your data in the manner and for the purposes described above. Consent to data collection and storage may be withdrawn at any time with effect for the future. Remarketing is not used on sensitive website content containing personal data.

6b - Google Ads Conversion

This website also uses Google Conversion Tracking. In this case, Google Ads places a cookie on your computer if you reached our website through a Google advertisement. These cookies expire after 30 days and are not used for personal identification. If a user visits certain pages on an Ads customer’s website, Google and the customer can see that the user clicked on an advertisement and was redirected to that page. Each Ads advertiser receives a different cookie. Cookies therefore cannot be tracked across the websites of Ads advertisers. The information obtained through conversion cookies is used to create conversion statistics for Ads customers who have opted into conversion tracking. Advertisers learn the total number of users who clicked on their advertisement and were redirected to a page containing a conversion-tracking tag. However, they do not receive information that could personally identify users. Consent to data collection and storage may be withdrawn at any time with effect for the future.
